Terms and Conditions

The terms and conditions of sale listed here contain the policies of NZWA. By registering an account with NZ Whisky Auction you agree to be bound by these terms.

1.                      Definitions

The conditions that are listed below contain terms that are used regularly and may need explanation. They are as follows:

“NZWA” means NZ Whisky Auction which is a website managed and run by Quater Cask Limited

“the Buyer” means the person with the highest bid after close of auction 

“the Lot” means any item depicted within the sale for auction and in particular the item or items described against any lot number in the catalogue.

“the Hammer price” means the amount of the highest bid after close of auction in relation to a lot.

“the Buyer’s Premium” means the charge payable by the Buyer to NZWA as a percentage of the hammer price.

“the Reserve” means the lowest amount at which NZWA has agreed with the Seller that the lot can be sold.

All values expressed on NZWA are in New Zealand Dollars (NZD$). All bids, “hammer price”, “reserves”, “Buyers Premium” and other expressions of value are understood by all parties to be in New Zealand Dollars (NZD$) unless otherwise specified.

2.                     Pre Auction

i                   Examination of Item
Prospective Buyers are strongly advised to examine the item’s photo and information thoroughly . Neither NZWA nor the Seller provides any guarantee in relation to the nature of the item.

The item is otherwise sold “AS IS”

ii                     Description and Wording
All statements by NZWA in the entry for the item, or made orally or in writing elsewhere, are statements of opinion and are not to be relied upon as statements of fact. Such statements do not constitute a representation, warranty or assumption of liability by NZWA of any kind. NZWA  is  not responsible for any errors or omissions in the item’s description or any supplemental material.

Foreign buyers should note that all transactions are in New Zealand Dollars exchange rate calculation are done by credit card company and thus NZWA is not liable for any loss or damages due to any exchange rate issues. 

iii                     Buyer’s Responsibility
All property is sold “as is” without representation or warranty of any kind by NZWA . Buyers are responsible for satisfying themselves concerning the condition of the item.

3.                     During Auction

i                   Termination of Membership
NZWA reserves the right at our complete discretion to refuse participation in any auction and to reject any bid, further more terminate any registered account if we found any activity that is in breach of our rules.

ii                   Registration Before Bidding
Any prospective new buyer must register and pay a $10 registration fee.

iii                   Bidding for a lot
When making a bid, a bidder is accepting personal liability to pay the purchase price including the buyer’s premium and all applicable taxes, plus all other applicable charges.

iv                   Reserves
Unless otherwise indicated, all lots are offered without reserve. Any item with reserve will specified as such and will only sell once reserve price is met. 

v                  Refusing a Bid
NZWA has the right at its absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as it sees fit.

4.                     Post Auction

i.                   Buyers Premium
In addition to the hammer price, the buyer agrees to pay to NZWA the buyer’s premium. The buyer’s premium is 10% of the hammer price plus GST. (Goods and Services Tax) where applicable.

ii.                   Payment
The buyer must pay the full amount due (comprising the hammer price, buyer’s premium and any applicable taxes and GST) not later than 3 days after the auction date.

The item will not be processed until all clear funds have been received in NZWA account.

Payment can be made by direct bank transfer or credit card(will incur handling charge based on your credit card provider)

iii.                   Collection and storage
NZWA is entitled to retain items sold until all amounts due to us have been received in full in cleared funds. Subject to this, the Buyer shall collect purchased lots within 3 days after closing of auction. NZWA reserve the right to charge storage fee of $10.00 Plus GST per day after the 3rd day.

iv.                   Packing, Handling and Shipping
NZWA will provide a shipping fee based upon location. Insurance will be provided at the sole discretion of the buyer. NZWA takes no responsibility for the condition of the whisky during or after shipping. International shipping will be sent through DHL and any buyer in countries not supported by DHL will be contacted for alternative locations and in failing to doing so will be canceled and said lot will be offered to the second highest bidder. NZWA is not liable for any damages caused for said cancelation.

v.                   Non payment
On Willing a lot dull payment is due in 3 days time. Failure to pay will result in potential cancelation of the lot and it being offered to the second highest bidder. NZWA retain the right to claim for loss and damages and will reserve the right to take legal action.

6.                     Copyright

NZWA hold all rights to imagery and wording on this site and on all our social media accounts. NZWA reserve the right to claim damages against any and all illegal use of said materials

8.                   Sale Results

NZWA will provide auction results, which will be available as soon as possible after the sale. Results will include buyer’s premium. These results will be posted at www.nzwhiskyauction.co.nz

9.                   Local Taxes (GST)

GST(NZ local Goods and Sales Tax) is applicable on the final hammer price plus buyer premium. For foreign buyers local custom clearance and VAT may apply NZWA will not be help liable for calculating said fee.
